Information on the right of withdrawal for consumers

1. Right of withdrawal for consumers

Consumers within the meaning of Section 13 of the German Civil Code (BGB) generally have a statutory right of withdrawal when entering into a distance contract; we provide information on this as follows. Exceptions are set out in point 3. In point 4, we provide a model withdrawal form.

Right of withdrawal

You have the right to cancel this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you, or a third party nominated by you – who is not the carrier – took possession of the goods.

To exercise your right of withdrawal, you must notify us

by means of a clear statement (e.g. letter, fax, email or telephone call) of your decision to withdraw from this contract. You may use the attached model withdrawal form for this purpose, although this is not compulsory.

To comply with the withdrawal period, it is sufficient for you to send your notification of your intention to exercise your right of withdrawal before the withdrawal period expires.

2. Consequences of withdrawal

If you withdraw from this contract, we must refund all payments we have received from you – including delivery costs (with the exception of any additional costs arising from a different delivery method chosen by you) – without delay and at the latest within fourteen days.

We will use the same payment method for the refund as you used for the original transaction, unless we have expressly agreed otherwise with you. Under no circumstances will you be charged any fees in connection with this refund.

We may withhold the refund until we have received the goods back or you have provided proof of return – whichever occurs first.

You must return or hand over the goods to us without delay and, in any event, no later than fourteen days from the date on which you inform us of your withdrawal from this contract. The deadline is deemed to have been met if you post the goods before the deadline expires.

You are responsible for the direct costs of returning the goods.

You will only be liable for any loss in value of the goods if this loss is attributable to handling of the goods that goes beyond what is necessary to check their nature, characteristics and functioning.

3. Exclusion of the right of withdrawal

The right of withdrawal does not apply to contracts for the supply of goods,

• which are not prefabricated and the manufacture of which depends on an individual choice or specification by the consumer, or
• which are clearly tailored to the consumer’s personal needs.
